Top Republicans 'outed' by gay marriage
WASHINGTON (Christian Examiner) – More than 300 Republicans, many with ties to the Grand Old Party hierarchy as well as the campaigns of Mitt Romney, John McCain and Dick Cheney, have signed a friend of the court brief urging the U.S. Supreme Court to legalize gay marriage when it considers the issue in a matter of weeks.
The list even includes names tied to George W. Bush and Ronald Reagan, and actor and movie producer Clint Eastwood signed the original document, but an amended list excludes his name.
Republicans with ties to front runners for the GOP presidential nomination have since signed on as well: Scott Walker's deputy campaign manager in 2011-2012, Dan Blum, added his name as did David Kochel, potential campaign manager for Jeb Bush in 2016.
However, Kochel, who now works for Bush's political action committee, subsequently told TIME he withdrew his name because in his role with the PAC, "I have decided not to sign advocacy petitions of any kind," he said.
But Ken Mehlman, who is gay, is leading the charge. His is the first signature and he is named in the actual title of the writ of certiorari. Mehlman was campaign manager for President Bush during his successful reelection in 2004, and chairman of the Republican Party from 2005-2007. But he did not publicly acknowledge his homosexuality until 2010.
The brief purports to represent true conservatism, claiming in the document that a conservative view sees that "marriage is strengthened, not undermined ... by providing access to civil marriage for same-sex couples." Indeed, the Boston Globe quotes Mehlman as saying "Supporting marriage equality is, in fact, the conservative position."
However, at least for the last three presidential election cycles, the Republican Party national platform has consistently argued against Mehlman's position and the claims presented in his namesake "conservative" amici curiae brief:
In 2004, when Mehlman was running President Bush's reelection campaign, the platform recognized "the importance of having in the home a father and a mother who are married. The two-parent family still provides the best environment of stability, discipline, responsibility, and character. We recognize that fathers play a critical role in providing stability for their children. Studies show that children are much more likely to do well in school and avoid crime and drugs when they have a responsible father in their lives. Promoting responsible fatherhood will have long-lasting benefits for families and for communities."
In 2008, shortly after he left the post of party chairman, the official Republican position, presumably shaped in part by the recently departed Mehlman, said "our children's future is best preserved within the traditional understanding of marriage" and called for a constitutional amendment "that fully protects marriage as a union of a man and a woman, so that judges cannot make other arrangements equivalent to it" and supported "the right of the people of the various states to affirm traditional marriage through state initiatives."
In 2012, during Mitt Romney's run for the White House, Republicans called an activist judiciary "perhaps even more dangerous than presidential malfeasance" and cited as a "blatant example" the "court-ordered redefinition of marriage in several States." This particular plank called such judicial legislating "an assault on the foundations of our society, challenging the institution which, for thousands of years in virtually every civilization, has been entrusted with the rearing of children and the transmission of cultural values." The policy statement also reaffirmed "marriage as the union of one man and one woman" and applauded states "which have enshrined in their constitutions the traditional concept of marriage."
Meanwhile, Mehlman and his confederates insist they are simply supporting these same conservative values in calling for the legalization of gay marriage.
"It is precisely because marriage is so important in producing and protecting strong and stable family structures," they write, "that amici do not agree that the government can rationally promote the goal of strengthening families by denying civil marriage to same-sex couples."
